TRICKSTER NFT is a collection of digital artworks (NFTs) operating on the Polygon (Pol) blockchain. This website serves solely as an interface for participants to exchange digital collectibles. Users are fully responsible for the security and management of their own private Polygon wallets and for verifying all transactions and contracts generated by this website before approving them. Furthermore, since the TRICKSTER NFT smart contract operates on the Polygon network, there is no way to reverse, cancel, or restore any transactions.

This website and its associated services are provided “as is” and “as available” without any warranties. By using this website, you take full responsibility for all transactions involving TRICKSTER NFT digital collectibles.

### 1. GENERAL PROVISIONS

 

1. Ownership of the NFT

You own the NFT you purchase. Each TRICKSTER NFT is an NFT on the Polygon blockchain. Upon purchasing an NFT, you fully own the associated TRICKSTER NFT image. Ownership of the NFT is established through the smart contract and Polygon blockchain: at no point can we confiscate, freeze, or otherwise alter ownership of any TRICKSTER NFT.

2. Personal Use

Subject to your continued compliance with these terms, TRICKSTER NFT grants you a worldwide, royalty-free license to use, copy, and display the purchased NFT artwork, along with any extensions you choose to create or use, solely for the following purposes:

(1) For your own personal, non-commercial use;

(2) As part of a marketplace that permits the purchase and sale of your NFT, provided that the marketplace cryptographically verifies the ownership rights of each TRICKSTER NFT owner to display their NFT; or

(3) As part of a third-party website or application that permits the inclusion, involvement, or participation of your NFT, provided that the third-party website or application cryptographically verifies the ownership rights of each TRICKSTER NFT owner to display their NFT to ensure that the artwork is no longer visible once the owner leaves the website or application.

3. Commercial Use

Subject to your compliance with these terms, TRICKSTER NFT grants you an unlimited worldwide license to use, copy, and display the purchased artwork for creating derivative works based on the NFT. Examples of such commercial use include producing and selling merchandise featuring the artwork. For clarity, nothing in this section shall be construed as restricting you from:

(1) Owning or operating a marketplace that permits the use and sale of TRICKSTER NFT tokens generally, provided that the marketplace cryptographically verifies the ownership rights of each token owner;

(2) Owning or operating a third-party website or application that permits the inclusion, involvement, or participation of your TRICKSTER NFT; or

(3) Earning revenue from any of the above.

4. Copyright

PATRIMONY COMPANY is the exclusive owner of the TRICKSTER NFT brand and trademark. Initially, the entire TRICKSTER NFT collection is owned and affiliated with the cryptocurrency wallet 0xBDC2fed2fB23Ebe9103B4dE13005212fE55ED0bc, which acts as the source and issuer of the TRICKSTER NFT collection. Copyrights for your NFT images from the TRICKSTER NFT collection are tied exclusively to the cryptocurrency wallet used for the purchase or transfer of the respective NFT. Copyright remains with the NFT owner until the NFT is sold or transferred to another wallet. At that point, all copyrights are assigned to the new cryptographically verified owner. Aside from rights to the NFT, you do not receive rights to any other trademarks or intellectual property belonging to TRICKSTER NFT or PATRIMONY COMPANY. All such rights are explicitly retained by the original author, PATRIMONY COMPANY.

5. Further Activities and Profit Generation from TRICKSTER NFT Projects

We present our recuperative strategy for potential return and growth of your investment in acquiring TRICKSTER NFT tokens. This strategy involves creating a series of commercial products based on TRICKSTER NFT, generating and distributing profits from these products among TRICKSTER NFT token holders, where and if such profits occur.

This model grants PATRIMONY COMPANY the exclusive and sovereign right to determine, at its discretion, the return of payments to TRICKSTER NFT token holders from the net profits of companies derived from TRICKSTER NFT, as well as other businesses, including those integrated into the PATRIMONIUM METAVERSE or participating in the development of commercial products based on TRICKSTER NFT. Additionally, this model allows for the potential return of a share of profits from community-driven commercial projects based on TRICKSTER NFT to token holders. In some cases, the results of commercial activities will be managed by the community of TRICKSTER NFT token holders.

Furthermore, this strategy provides opportunities for TRICKSTER NFT token holders to generate income from operations involving land in the PATRIMONIUM metaverse. Token holders can use acquired virtual land plots for various commercial purposes, such as renting, selling, exchanging, or developing infrastructure. Additionally, TRICKSTER NFT token holders possessing PatryMoney cryptocurrency will have the opportunity to participate in trading and other operations with this digital currency.

However, we cannot guarantee the implementation of these projects if the TRICKSTER NFT collection is not sold out entirely. We also emphasize that we do not act as the organizer but encourage the community to unite their efforts in creating commercial ventures based on TRICKSTER NFT images. All decisions regarding management, investments, and profit distribution will be made through collective voting by token holders. We only provide a platform and brand for the establishment of joint ventures. Many aspects of operations will be determined by the TRICKSTER NFT token holders' community.

It is important to highlight that ownership of TRICKSTER NFT tokens grants you rights to the digital image and its copyrights only. The information provided on this website does not constitute a promise of profit, advice, or an invitation to enter into agreements for investment purposes. We do not offer securities or other financial products, nor do we guarantee returns. All your decisions and actions are based on your personal choice and responsibility.

If any holder of TRICKSTER NFT tokens purchased from the collection issuer, PATRIMONY COMPANY, expresses dissatisfaction with these assets for any reason, the issuer reserves the right, at its discretion, to refund the purchase price of the tokens in exchange for the respective TRICKSTER NFT tokens and PatriMoney coins. Upon such a refund, the matter will be resolved, and any claims will be deemed invalid.

(b) Dispute Arbitration. You agree that any Dispute shall be resolved exclusively through binding individual arbitration and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator shall have exclusive authority to resolve all issues relating to the interpretation, applicability, enforceability, and scope of this arbitration agreement. All filing, administration, and arbitrator fees will be governed by the applicable arbitration rules within the European Union. If your claim is deemed frivolous, we reserve the right to deny reimbursement of any arbitration-related expenses. In the event we prevail in arbitration, you shall reimburse all attorney fees and costs incurred by us.

(c) Class Action Waiver. You and PATRIMONY COMPANY agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims from multiple parties and may not preside over any form of class or representative proceeding. If this provision is found unenforceable, the entire dispute resolution section will be nullified.
